1. Acceptance of Terms

By accessing or using the Envysky flight training management platform, including its web and mobile applications (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including pilots, student pilots, flight instructors, and company administrators.

2. Description of Service

Envysky provides a digital platform for flight schools and pilots to manage flight training, scheduling, logbooks, aircraft maintenance records, and related communications. The Service is provided on a subscription or company-sponsored basis.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information when registering.
• You are responsible for all activity that occurs under your account.
• You must notify Envysky immediately of any unauthorized use of your account.

4. SMS Notifications – Terms of Use

Program Description

Envysky sends automated SMS text messages to users who have opted in to receive notifications. These messages include flight booking confirmations, scheduling updates, cancellation notices, and operational alerts related to your flight training activities.

How to Opt In

You can opt in to SMS notifications by providing your mobile phone number and checking the SMS consent checkbox within your Envysky profile or pilot onboarding form. By opting in, you consent to receive recurring automated text messages from Envysky at the number provided.

Message Frequency

Message frequency varies. You may receive messages each time a flight booking is created, updated, or cancelled on your behalf.

Message and data rates may apply. Check with your mobile carrier for details.

How to Opt Out

You may opt out of SMS notifications at any time by:

• Texting STOP to any SMS message from Envysky.
• Disabling SMS consent in your profile settings within the Envysky app.
• Contacting us at privacy@envysky.com.

After opting out, you will receive one final confirmation message. No further messages will be sent unless you opt back in.

Supported Carriers

Envysky SMS notifications are supported on all major US carriers including AT&T, T-Mobile, Verizon, Sprint, and others. Carrier support may vary.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload false, misleading, or inaccurate flight records or documents.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to transmit unsolicited communications.

6. Flight Safety Disclaimer

Envysky is a management and communication platform only. The Service does not provide flight instruction, aeronautical guidance, or aviation safety advice. All flight decisions remain solely the responsibility of the pilot in command and the certified flight instructor. Envysky is not liable for any aviation incidents, accidents, or unsafe flight operations.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, and software — are the exclusive property of Envysky and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, Envysky shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of or inability to use the Service.

9. Termination

Envysky reserves the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by updating the effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
